1. Roles: Controller & Processor

Schools and organizations that sign up for TeamCloud are typically the data controllers for their users (students, parents, trainers). TeamCloud is the data processor that stores and processes data on behalf of the schools. Where TeamCloud collects data directly (for account management, marketing, or support) we act as controller for that data.

• To provide, operate and maintain the service;
• To process payments and manage subscriptions;
• To communicate account updates, notifications and support;
• To perform analytics, product improvement and feature development;
• To protect against fraud and enforce terms of service.

4. Legal Basis for Processing (GDPR)

Where GDPR applies, our legal bases include: performance of a contract (providing the service); legitimate interests (service improvement, fraud prevention); consent (marketing communications or analytics where required); and compliance with legal obligations.

5. Sharing & Third Parties

We do not sell personal data. We share data only when necessary:

• With service providers (payment processors, email delivery, analytics providers) under contract to process data on our behalf;
• When required by law or to respond to legal processes;
• To protect rights, property or safety of TeamCloud, our users, or the public.

Typical processors include: AWS (hosting), Stripe / Fondy / LiqPay (payments), Google Analytics, Mixpanel, Hotjar (analytics). All processors are required to maintain adequate safeguards (DPAs where needed).

6. Consent for Processing & Transfers

By using TeamCloud and providing personal data (including through forms or registration), you provide informed consent to process and transfer your data to third parties described above for the purposes stated in this Policy.

If transfers occur outside the European Economic Area, we ensure adequate safeguards (standard contractual clauses, or other lawful transfer mechanisms) are in place.

7. Data Security

We use reasonable technical and organizational measures to protect personal data: HTTPS/TLS for data in transit, encryption at rest where applicable, role-based access controls, secure hosting (AWS), and routine security monitoring. However, no method of transmission or storage is 100% secure.

8. Cookies & Tracking

We use cookies for essential site functionality and analytics. Users can adjust browser cookie settings, but disabling cookies may reduce functionality.

9. Data Retention

We retain personal data for as long as the account is active, as needed to provide services, comply with legal obligations, resolve disputes, and enforce agreements. After account deletion, data may be retained for a limited backup and legal period (typically up to 12 months) before deletion or anonymization.

10. International Transfers

Data may be processed in servers located in the EU (e.g., AWS Frankfurt) or other jurisdictions. We apply proper safeguards (SCCs, DPAs) to protect transfers from the EU/EEA to third countries.

11. Your Rights

Depending on your jurisdiction, you may have rights including access, correction, erasure, restriction, portability, and objection to processing. You may also withdraw consent where processing is based on consent. To exercise your rights, contact privacy@teamcloud.com.ua. You may lodge a complaint with a supervisory authority (e.g., data protection authority or Ombudsman).

12. Changes to this Policy

We may update this Policy periodically. Substantive changes will be communicated at least 30 days prior to taking effect via email or in-app notification.
